1. Agreement

These Terms govern your use of Voice Kata at voicekata.com (the “Service”). By using the Service you agree to them and to the Privacy Policy. If you do not agree, please do not use the Service. You must be at least 16 years old to use it.

The Service is operated by Gabriel Policiuc, operating as Voice Kata, Prof. Nicolae Oblu, nr. 18, Iași, Romania (“we”).

2. What the Service is

Voice Kata is a browser game you play with your voice. You sing to charge a wand, stop singing to throw, and keep the zombies at bay. The coast is free, with no account and no sign-up.

The Service may change over time. We may add, alter or remove features and levels. We may also withdraw the Service entirely.

3. Your microphone

The Service works only with your permission to use your microphone. Your browser asks for that permission, and you can withdraw it at any time in your browser settings. Pitch detection runs inside your browser; your audio is never sent to us or to anyone else. The Privacy Policy has the detail.

4. Acceptable use

Please do not:

use the Service for any unlawful purpose;
disrupt, overload or attempt to break the Service;
probe it for vulnerabilities without our permission;
access it by automated means at a scale that degrades it for other people.

We may block access for anyone who breaks these rules.

5. Intellectual property

The Service — its design, code, artwork, sounds, characters and text — belongs to us or our licensors, except for third-party components used under their own licences. You may use the Service for your own play. You may not copy, redistribute, sell or create derivative works from its content without our permission. You may record and share videos of your own play.

6. Not professional advice

Voice Kata is a game, not a singing lesson and not a medical, therapeutic or clinical service. It does not diagnose or treat any voice, speech or hearing condition, and it is not a substitute for a qualified voice teacher, speech therapist or doctor. Sing at a comfortable volume and pitch. If your voice hurts, stop. If you have pain, hoarseness or any persistent difficulty with your voice, see a professional.

7. Availability and accuracy

The Service is provided “as is” and “as available”, without warranties of any kind, to the maximum extent permitted by law. We do not promise that it will be uninterrupted or error-free, or that pitch detection is accurate; it depends on your microphone, your surroundings and your device.

8. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service is limited to the amount you have paid us in the twelve months before the claim, which is zero because the Service is free. We are not liable for indirect, incidental or consequential damages.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Your rights as a consumer under Romanian and EU law are not affected.

9. Changes to these Terms

We may update these Terms. The “Last updated” date changes when we do. Continuing to use the Service after a change means you accept it; if you do not, stop using the Service.

10. Governing law and disputes

These Terms are governed by Romanian law, and disputes fall to the competent courts of Iași, Romania. If you are a consumer resident in the European Union, you keep the protection of the mandatory rules of your country of residence and may bring proceedings there.

If you have a complaint, write to us first; most things are quick to sort out. Consumers in Romania may also contact the Autoritatea Națională pentru Protecția Consumatorilor (ANPC), anpc.ro.
